These terms and conditions of use (“Terms”) govern your use of LawyerZee’s websites, mobile applications, products, and services (collectively, the “Services”). Please read them carefully before accessing or using the Services.
By accessing this website or using the Services, you agree to these Terms, LawyerZee’s Privacy Policy, and LawyerZee’s Community Guidelines. If you have any questions, please contact us at [email protected].
1. Using Our Services
You may use the Services only if you can form a binding contract with LawyerZee. Use of the Services by individuals under the age of majority in their state of residence is not permitted. In no event may the Services be used by individuals under the age of 13. If you are using the Services on behalf of an entity, you agree to these Terms on behalf of that entity.
Using our Services does not grant ownership of any intellectual property rights in the Services or the content accessed through them. Except for browsing or accessing our Services as permitted by these Terms, you may not use content from the Services unless authorized by the content owner or by law. These Terms do not grant you rights to use any branding or logos used in our Services. You may not remove, obscure, or alter any legal notices displayed on or in conjunction with the Services.
Do not use the Services on any device in a manner that distracts you or violates traffic or safety laws.
We may release Beta Services (unfinalized products, services, or features) during a Beta Test phase. Beta Services may contain errors, are not guaranteed to be commercially released, and may be withdrawn at any time. LawyerZee provides Beta Services “as is” without warranties of any kind, express or implied, to the fullest extent permitted by law.
2. Information on the Services
Our Services include content created by LawyerZee as well as third-party content (the “Legal Information”). While we may review third-party content to determine whether it violates our policies or the law, we do not routinely screen all third-party content. This includes Legal Information provided by lawyers. LawyerZee does not guarantee the accuracy, adequacy, or quality of such Legal Information, or the qualifications of those providing it.
3. No Formation of an Attorney-Client Relationship
The Legal Information provided through LawyerZee is for general informational purposes only and is not a substitute for professional legal advice. Accessing this information, corresponding with a lawyer through the Services, or using any aspect of the Services does not create an attorney-client relationship between you and LawyerZee or between you and any lawyer. Always consult a qualified attorney licensed in your jurisdiction for specific legal concerns.
4. Interactions Between Lawyers and Consumers
LawyerZee serves as a platform for lawyers and consumers to connect. Any attorney-client relationship that forms as a result of interactions on LawyerZee is solely between the lawyer and the consumer, not LawyerZee. LawyerZee does not guarantee the quality or accuracy of any legal services provided by lawyers listed on the platform. LawyerZee is not a lawyer referral service, except as required by applicable laws or regulations.
5. Premium Services for Lawyers
LawyerZee offers subscription-based services for lawyers (the “Premium Services”). By selecting a Premium Service, you agree to pay the applicable subscription fees (“Subscription Fees”) and provide a valid payment method. Subscription Fees are charged when the Premium Service begins and recur on a monthly or annual basis until canceled.
Cancellation and Refunds: To avoid billing for the next period, Premium Services must be canceled before the renewal date. Subscription Fees are non-refundable and non-prorated.
If your payment method fails, LawyerZee may suspend or terminate your Premium Services. Premium Services may include the publication of advertising or website content you provide (“Premium Services Content”). By providing such content, you grant LawyerZee and its affiliates a license to use and distribute the content for the purpose of delivering the Services.
6. Legal Advertising and Communications
Lawyers and law firms are solely responsible for ensuring that any information or advertisements they post on LawyerZee comply with all applicable laws and professional conduct rules, including those regarding advertising and client communications.
7. Copyright
LawyerZee responds to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act (DMCA). Repeat infringers’ accounts may be terminated.
8. Disclaimer of Warranties
The Services are provided “as is” without any warranties, express or implied. LawyerZee and its affiliates disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. LawyerZee does not guarantee the accuracy or completeness of Legal Information provided through the Services.
9. Limitation of Liability
To the fullest extent permitted by law, LawyerZee and its affiliates will not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, resulting from your use of the Services. Total liability for any claims is limited to the amount you paid for the Services in the 12 months preceding the claim.
10. User-Posted Content
Users may post content, including reviews, comments, and other materials (“User Content”). By posting User Content, you grant LawyerZee a worldwide, royalty-free license to use, modify, and display the content. You remain responsible for the content you post and must comply with the Community Guidelines.
11. Indemnification
You agree to indemnify and hold harmless LawyerZee and its affiliates from any claims, damages, or expenses arising from your use of the Services, including User Content you post or your violation of these Terms.
12. Modifications
LawyerZee reserves the right to update these Terms at any time. Significant changes will be communicated to users. Continued use of the Services after updates constitutes acceptance of the revised Terms.
13. Mandatory Arbitration and Dispute Resolution
Any disputes arising from these Terms will be resolved through binding arbitration under JAMS rules. Exceptions include small claims court actions and cases involving injunctive relief for intellectual property violations. Users may opt out of arbitration by notifying LawyerZee in writing within 30 days of agreeing to these Terms.
14. Governing Law
These Terms are governed by the laws of the State of Oklahoma. Any disputes will be resolved in courts located in Oklahoma, except where arbitration applies.
15. Termination
LawyerZee reserves the right to suspend or terminate your access to the Services for violations of these Terms or other reasons. Upon termination, you forfeit access to data stored within the Services.
16. Entire Agreement
These Terms constitute the entire agreement between you and LawyerZee regarding the use of the Services and supersede all prior agreements.
17. Waiver and Severability
Failure to enforce any provision of these Terms does not constitute a waiver. If any provision is deemed unenforceable, the remaining provisions remain in full effect.
